There's no guarantee in any part of life no matter who you
are, where you are, or how much you strive to take care. You can no longer hide away from evil abroad. It is here. It is alive. It is all around us affecting all from every aspect of life. From the most noted to the most common grounds and people, that evil can and will invade. And it's not always the bad guys who lose. Sometimes innocence and honor suffers.
Our Brian died for the defense he gave to a beaten girl. Due to his stand to protect her from further harm, the man who killed him got incredibly angry. It is believed he harbored this anger even as he left because he did verbally make the statement of his intent to kill. And he did this knowing that Brian would be coming in his presence again to ensure the girl he'd protected got home safely.
That was proven by the way his intention was stated. This is a killer who was plagued by problems and armed with a
rifle. Whether he has any form of drug addictions, mental instabilities or any lack of needed medication to control which he knowingly did not
get and take can excuse what he did to Brian. He cannot justify.
The girl this man had abused was none other than his own niece and he himself had at one time been considered a friend by the boy he slaughtered that fatal day.
The accused had argued with my nephew Brian earlier that day over the last time he'd beaten on the girl Brian was with.
The man was indeed told not to ever lay another harmful hand on her or he'd answer to justice dealt by a similar blow. Being the brass tacks common sense country boy that Brian was, he flatly told
the murderous man that if he ever hit the girl again he would kick his ass. This angered
the man immensely as well as embarrassing him to be called down by a younger
man. It led to the verbal argument that festered in the accused until he lifted that lethal weapon. The following account was told by a member of the man's own family who was present at the time of the crime. Upon reaching his home
the accused man told his family to
"stand back" because when Brian came there he was going to kill him. He actually gave the stated intent that he would kill Brian. And I remind you, he did this knowing that Brian would be coming there to bring the girl home. On arrival some time later, Brian got out of the truck he rode in with his friend and the girl he'd defended. When he did,
the accused man came out of his house by kicking open the front door, he called my nephew's name. Brian turned around at the sound of his name and the first shot was fired. It's been said that the first shot was the fatal one. It was reported that the first murderous bullet that invaded my nephew's chest killed him instantly. And I have to pray that it's so because you
see, one shot was not enough to satisfy the evil and driven lust for blood. The rifle that
the killing man held was "allegedly" fired 5 more times by him after the
first, all aimed directly at Brian. Four fatal shots hit Brian in the chest
area, one of the shots hit his neck. One shot was fired into the tire of the truck
to prevent all possibility of escape should he have lived through the onslaught but the bottom line is,
the murdering man continued to fire intently targeted upon a fallen man. It was a deliberate death. It was dealt by a savage man.
It is widely reported throughout the county that the
family of this man has a long history of murderous acts even among themselves.
It is said that there
have been many killings among the ranks of their feuding own family tree.
Killing to them isn't something they do without thinking or as a result of self
defense, even without just cause. Killing seems to be their lifestyle. When the
people who live there are asked it is easy to to be told that "these
people" are simply nothing but "mean" in the deepest degree. And
even though adopted into this lineage, the man who murdered this day is no
different. With the first shot being the one that killed Brian the other savage shots were nothing more than a demonic desire to keep shooting the dead. That man absolutely fully meant the one that we loved so would die. That was the fury unleashed.
And they say that he's insane. Does the stated intent of premeditated murder sound like insanity to you?
It sounds like a planned act to me. Could he say that he feared for his life? In doing so did he deem it needed to fire directly upon an unarmed and unprepared man? Does
the calling and killing of an unarmed man who has his back turned sound like an
act of self defense? Does the deliberate firing of 5 deadly shots into one already dead man sound like lunacy? Maybe, I suppose to play devil's advocate it possibly could. But it could have been prevented. That man made his thinking choice. He DECIDED Brian would die.
After his maliciously murderous deed was done the man simply turned and walked
back in his house. He left his young victim on the ground in a pool of his
blood. He'd gotten the purely evil satisfaction he needed. Brian had his back to this man. But
the killer wanted to look in his eyes.
And he wanted to see him die. Well Mr. "accused" I say to you with no respect whatsoever, you did get what you wanted. However I wager you never wanted what's due to come to you. If it is your intent to claim insanity, fine. Claim you're incompetent. If it is your intent to blame lack of needed medication, fine. Claim your ignorance. Claim
your medical neglect. If it is your intent to claim your defense, fine. Claim your own folly too. Although I stand here today strong and assured to say, we are ready for you.
God forgive me but I find it hard to care at this point if
you even continue to breathe so don't make the mistake of thinking or hoping for complacency or sense dulling shock in the ranks of Brian's family. I really don't care enough to give a good damn if you ever live a free day again. In fact I guarantee you that I will do all within the reach of every resource I can find to assure that you NEVER see freedom
again.
I'm sure you didn't realize or count on contending with Congress when you pulled that trigger. But
you WILL do so now. You can call it done. When it's all written and decreed, you will
remember Brian's Law.

" The deceased must be protected and given a voice "

The name of the man charged with this crime is certainly well known as there were several witnesses to the murder itself as well as the stated intent to do so before the deed was done. However in interest of reducing risk to the prosecutors case, he cannot be named here as yet. The man who committed this criminal deed will be referred to on this site as "the accused" or "the defendant" among other generic titles. He has been arrested and received a bond of $100,000 although no plea has been entered into evidence and the preliminary hearing for this case has yet to be held. Until such time as more evidence is presented on public record it must be done in this way. Legal purposes of protection to this organization and it's efforts to legally assist the due process of justice decree that I must remind, all defendants are considered innocent until proven guilty in a court of law.
